1. About these terms

These terms apply when you use iPaintD.com (the “site”), whether you are just looking up colours or you have an account. iPaintD.com is operated from Queensland, Australia. In these terms, “we”, “us” and “our” mean the operator of the site, and “you” means the person using it.

By using the site or creating an account, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.

2. What the site does

The site is a record of the paint colours used on Australian homes and a directory of painters. In short:

• Anyone can search for a property and see the colours recorded for it, print a Print for Store sheet and share a profile link, without an account.
• Professional painters with a Pro account record the colours they use on each job, and appear in the painter directory.
• Homeowners can record their own home’s colours by buying a DIY profile.
• Visitors can send painters quote requests and messages, ask for a profile to be updated, and report a profile.

3. Colours are a guide only

Please read this section carefully. Colour information on the site is provided as a guide and is not a guarantee.

• Colours on screens and printed sheets never look exactly like paint. Screens, printers, lighting, sheen and the surface all change how a colour looks.
• Colour records are entered by painters and homeowners. We do not inspect properties, and we cannot confirm that a record matches what is actually on the walls, or that a property has not been repainted since.
• Hex and RGB values are approximate screen colours. They are added by painters and homeowners, by our staff, or suggested by our AI lookup; they are not colour data supplied by paint manufacturers. Values marked “Please check” have not been confirmed.
• A colour only matches when it is tinted into the same paint brand, range and sheen as before. Many colours are tinted into a different brand’s paint; the same colour in another brand’s paint, including the colour brand’s own paint or sample pots, can look noticeably different. Buy touch-up paint exactly as recorded on the profile.
• Before you buy or apply paint, check the recorded details against the old tin label or with the painter where you can, and ask your paint store to confirm the tint formula for that paint.

We are not responsible for the cost of paint, labour or rework caused by relying on colour information from the site without checking it first, except to the extent the Australian Consumer Law says otherwise (see section 15).

4. Accounts

• You must be at least 18 years old to create an account.
• Give us accurate details and keep them up to date. Painters must keep their business details current.
• Keep your password private. You are responsible for what happens under your account. Tell us straight away if you think someone else has used it.
• One person or business per account. You may not sell, transfer or share your account.

5. Property profiles and what you publish

Property profiles are public and can be found by anyone searching the site. When you create or edit a profile, you promise that:

• you painted the property, own it, or have the owner’s permission to record its colours;
• the information is accurate as far as you know, and you will correct it if you find it is wrong;
• you will not include anyone’s name, contact details, photos of people, or any other personal information in addresses, notes or colour names, beyond the property address itself;
• you will not copy colour data, swatch images, photos, descriptions or other material from paint manufacturers’ websites, catalogues or apps into the site unless that manufacturer has given permission. Recording the brand, colour name and code you used, from the tin, fan deck or your own records, is fine;
• you will not publish anything unlawful, misleading, offensive or that infringes someone else’s rights.

Homeowner profiles are published as soon as they are saved and cannot be unpublished by the homeowner, but you can edit them at any time. Painters can keep profiles as drafts until they choose to publish.

6. Removing a profile

If you own or live at a property and do not want its colours shown, or a profile is wrong or out of date, use the Report link on the profile or contact us. We review every report and may hide or remove a profile, or ask the painter or owner to update it. We may also hide or remove any profile at our discretion, for example for privacy or safety reasons.

7. Painters

If you list your business on the site:

• You must hold the licences your work requires, including a current QBCC licence for work in Queensland where one is needed. We check licence numbers but a “verified” mark is not an endorsement or a guarantee of your work.
• Your business profile, phone number, email, licence number, ABN, service areas, ratings and reviews are shown publicly.
• Quote requests and messages are sent to you so you can reply. Any agreement for painting work is between you and the customer. We are not a party to it and are not responsible for the work, the price or payment.
• You may reply once to each review. You must not post or arrange fake reviews, or pressure customers about reviews.
• You must not use contact details you receive through the site for anything other than responding to that enquiry.

8. Prices, payments and subscriptions

All prices are in Australian dollars and include GST. Payments are processed by Stripe; we do not see or store your full card number.

DIY profiles

A DIY profile costs $9.95, paid once before you start recording. It covers one property, including later edits, the Print for Store sheet and the share link. A paid recording that you have not used yet stays in your account.

Pro subscriptions

• Pro costs $29.95 per month or $299.50 per year, unless a discount applies.
• Your subscription renews automatically at the end of each billing period and your saved payment method is charged, until you cancel.
• You can cancel at any time. Cancelling stops future renewals; you keep Pro until the end of the period you have paid for. If you switch between monthly and annual billing, the change may be charged or credited on a pro-rata basis.
• If a payment fails we will let you know. If it is not fixed, your account moves to the free plan.

Free periods, discounts and gifts

• A free period means you are not charged until it ends. Your card is saved at sign-up and charged automatically when the free period ends unless you cancel before then. We email you before the first charge.
• Discounts apply only as described when you sign up, only to new sign-ups unless we say otherwise, and cannot be combined; you get the best one available. Limited offers end when their places run out or on their end date.
• Gifted accounts and gifted recordings are free, have no cash value, end on the date shown, and can be withdrawn if these terms are breached.

Refunds

Fees are not refundable for change of mind or for part of a billing period, except where the Australian Consumer Law gives you a right to a refund (see section 15). If something has gone wrong, contact us and we will work with you to fix it.

Price changes

We may change our prices. We will give Pro subscribers at least 30 days’ notice by email before a new price applies to them, and you can cancel before it does.

9. AI colour lookup

The editor can suggest hex values using an artificial intelligence service. Only the colour brand, colour name, code and sheen are sent; no personal information is sent. The lookup does not copy material from paint manufacturers’ websites. AI suggestions are estimates and can be wrong. They are labelled as AI results, and you are responsible for checking a colour against the tin or fan deck before you save it. If you enter RGB values (for example from a fan deck), the site converts them to hex for you.

10. Acceptable use

You must not:

• break the law, or use the site to harass, threaten, mislead or harm anyone;
• copy, scrape or harvest the site’s data, or use bots or automated tools to access it, except for normal search engine indexing;
• try to get around our security, access other people’s accounts, or interfere with how the site works;
• upload viruses or harmful code;
• use the site to send spam or unsolicited advertising, including to painters through quote or message forms;
• create profiles for properties you have no connection to, or record colours you have not used or seen.

11. Your content

You keep ownership of the content you add to the site, such as colour records, notes, business descriptions, logos and photos. You give us a non-exclusive, worldwide, royalty-free licence to host, copy, display, adapt and share that content for the purpose of running, improving and promoting the site, including after your account closes for profiles that remain on the site. Colour records may be kept and shown after a painter’s account closes, so that owners can still find their colours.

12. Our content

The site’s design, software, text and logos belong to us or our licensors and are protected by law. Paint brand names, colour names and colour codes are trade marks or property of their respective owners. They are used on the site only to identify the colours used on a property, so that owners, painters and paint stores can find the right paint. The site is not affiliated with, sponsored or endorsed by any paint manufacturer. We do not copy material from paint manufacturers’ websites, and we ask users not to either. If you own a brand and have a concern about how it appears on the site, contact us and we will respond promptly.

13. Other services and links

The site uses other services, such as Stripe for payments and OpenStreetMap for maps, and may link to other websites. Their own terms apply to their services, and we are not responsible for them.

14. Availability

We work to keep the site running, but we do not promise it will always be available, error free or that records will never be lost. We may change, pause or stop parts of the site. If we stop offering Pro, we will give subscribers reasonable notice and refund any prepaid fees for the period after it stops.

15. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under that law. Where we are allowed to limit our liability for a failure to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.

16. Limitation of liability

To the extent the law allows:

• the site is provided “as is”, and we exclude all warranties and conditions not set out in these terms;
• we are not liable for any indirect or consequential loss, or for loss of profit, revenue, data or opportunity;
• we are not liable for loss arising from the actions of painters, homeowners or other users, or from work, prices or agreements made between users;
• our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose.

17. Suspension and closing accounts

You can close your account at any time by contacting us. We may suspend or close an account, hide a profile or listing, or refuse service if you break these terms, if a licence check fails, if we reasonably suspect fraud or misuse, or if the law requires it. Where it is reasonable, we will tell you why and give you a chance to fix the problem first.

18. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change materially affects you, we will tell you by email or on the site before it takes effect. If you keep using the site after that, the new terms apply.

19. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland.
